AMENDMENTS

Voting Limited to one (1) vote per person per submission. Fan Factory reserves the right to disqualify all votes in excess of these limits and/or which Fan Factory in its sole discretion believes do not comply with these Official Rules. The use of computer-generated programs or other means to submit multiple votes is prohibited, and such votes will be disqualified as determined by Fan Factory in its sole discretion. Any voter who violates these rules will have their vote(s) and/or Submission(s) disqualified. In the event of a tie or any problems in the public voting, Fan Factory will break the tie or determine the winners based on the initial judging results used to determine the winners, or using other criteria as deemed appropriate by Fan Factory in its sole discretion.

Conditions du concours IPANEMA France
The following promotion is reserved for residents of France. Please do not continue if you are not a legal resident of France.

- Chaque billet dans le commerce a une valeur commerciale d'environ 3 117,52 euros TTC et inclue le voyage au départ de Paris vers Rio de Janeiro (aller/retour) en classe économique incluant les repas servis à bord. Tous les autres services proposés par la compagnie en dehors du transport aérien et du repas servi à bord sont à la charge des passagers.
- Les billets auront une validité de 1 an. Ils devront être utilisés dans un délai de 1 an, à compter du 04/06/2012 ; leur date limite d’utilisation étant fixée au 04/06/2013.
- Réservations des vols en classe N sur les vols aller/retour*. La réservation sera soumise à la disponibilité des vols aux dates souhaitées.
*Réservations effectuées directement par TAM Airlines.
- Une fois la réservation effectué, le billet devra impérativement être émis dans un délai de 1 mois. Au-delà de cette période, le billet non émis sera comptabilisé comme utilisé.
- Toutes les taxes applicables sont à la charge des passagers. Elles devront être réglées lors de l’émission des billets.
- Les billets offerts ne permettent pas l’accumulation de points dans le programme TAM Fidelidade et ne permettent pas de bénéficier des services liés à ce programme.
- Les billets ne peuvent pas être commercialisés, sous peine d’une pénalité applicable (pénalité d’un montant de 200% -deux cent pour cent- de la valeur des billets).
- Ces billets ne pourrons pas être utilisés en haute saison, période d’embargo pour l’usage des billets offerts ; la période d’embargo correspond aux dates suivantes : du 29 juin au 24 août et du 16 au 30 décembre.
Les billets, une fois émis, ont une validité d’utilisation de 2 mois (deux mois).
Une fois effectuée l’émission des billets, ceux-ci sont :
- Non endossables ;
- Non transférables ;
- Non remboursables ;
- Itinéraire des billets non modifiable ;
- Surclassement non autorisé.

OUR LIABILITY
FanShake offers you a forum to submit User Comments, User Generated Content and User Hyperlinks and you agree to be responsible for all losses suffered by us arising out of any breach by you of these Terms and Conditions.
We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our reasonable control. In particular we shall not be responsible for any third party content you access within FanShake over which we do not have reasonable control. You irrevocably waive any right to claim against us for any losses you suffer as a result of accessing such third party content. Our liability shall not in any event include business losses of any nature whatsoever.
We do not guarantee the accuracy, completeness or quality of User Comments, User Generated Content or User Hyperlinks. You understand and agree that we may, but are not obligated to, review FanShake and may delete or remove (without notice) any User Comments, User Generated Content and/or User Hyperlinks in our sole discretion, for any reason or no reason.
Although we will use reasonable skill and care in providing access to FanShake, we give no promise as to the accuracy, completeness or quality of FanShake Content. If we are informed of any inaccuracies in FanShake Content we will (without obligation) attempt to correct the inaccuracies as soon as we reasonably can. Your access to FanShake may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as is reasonably possible.
Although we will implement reasonable security procedures to ensure that no unauthorised third parties gain access to FanShake, the inherently insecure nature of the Internet means that we do not and cannot guarantee the security of FanShake or any confidential information placed on FanShake.
The above limitations shall not operate to limit our liability in the event of fraud by us.

FanShake contains some links to websites where you may purchase goods or services associated with FanShake content. Part of FanShake may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that content submitted for inclusion on FanShake complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

Members of James Pendleton Staff or Family of James Pendleton Staff are not allowed to win the prize for the James Pendleton competition.
If you breach these Terms and Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

These Terms and Conditions constitute the entire agreement between you and us.
The construction, validity and performance of this agreement are governed by the laws of England and you submit to the exclusive jurisdiction of the English courts.
We may wish to send you information about our products or services, products or services offered by other companies within our group and/or products or services offered jointly with or on behalf of other organisations. To consent to receiving this type of information, you can opt-in by ticking the box during the registration process.
We may wish to share your personal information with third parties where we think that you might be interested in receiving information about their products or services. We will not do so without your express consent. To consent to such sharing of personal information, you can opt-in by ticking the box during the registration process.
If you later decide you no longer wish to receive information about the items listed above, send us an email any time at optout@fanshake.com.
We may also use and disclose information in aggregate (so that no individuals are identified) for marketing and strategic development purposes.
